SECTION VIII OFFICIALS CONTRACT

Preamble

Agreement made this July 1,2006, by and between the Section VIE Athletic Council, hereinafter referred to as the A.C., the Executive Director of Interscholastic Athletics, hereinafter referred to as the E.D. and Section VIE Officials' Coordinating Council, hereinafter referred to as the O.C.C.

Whereas, the A.C. is made up of the member schools of the N.Y.S.P.H.S.A.A. in Nassau County; and

Whereas, the E.D. is the executive arm of the A.C.; and

Whereas, the O.C.C. is made up of the officials' associations serving those schools in Nassau County; and

Therefore, in the best interests of Interscholastic Athletics in Nassau County, it is agreed that the A.C., the E.D., and the O.C.C. shall:

1.  Accept and abide by the Statement of Principles for officiating and the Constitution of the New York State High School Officials' Coordinating Federation (N.Y.S.H.S.O.C.F.) as written in the N.Y.S.P.H.S.A.A. Handbook:

2.  Accept and abide by the provisions of the Officials' Agreement as written in the above handbook.

3.  Agree upon a contract, the term of which shall extend from July 1, 2006 up to and through June 30, 2009 and which shall be subject to renewal thereafter, in accordance with procedures defined within the Officials' Agreement in the N.Y.S.P.H.S.A.A. Handbook. Said contract shall consist of the following articles: a.   Article I - Non-Monetary Conditions and Procedures, and

b.   Article II - Officiating Fees Schedule. The fees schedule shall define any and all fees or expenses relating to officiating of interscholastic athletics including all conference, league and sectional tournament competition sponsored by the Section VIII A.C.

1) Discussion and negotiation for all officiating fees or change in complement officials, other than those already stated in this contract, shall take place between a joint conference of representatives from the Fees Negotiating Committees of the A.C. and O.C.C. (An equal number from each.) Said joint conference will be chaired by the designated representative of the Superintendents' Board Section VIII.

2)  If playing conditions for a regular season contest change during the contract period, the officials' group may appeal to the Section VIII joint A.C./O.C.C. Committee on Officials for an increase in fee (to next category, etc.).

3) An ad hoc committee for the purpose of recruiting new officials shall be established. It will be composed of three members, one each from the Office of E.D., the A.C. and the O.C.C. They shall make specific and concrete recommendations to each of these three groups for recruiting new officials in each sport. This committee shall meet at least twice a year.

ARTICLE I - NON-MONETARY CONDITIONS & PROCEDURES

Section A - Assignment Procedures

1.  The Office of the E.D. shall make officiating assignments for interscholastic athletics on all levels to member schools of the A.C. Assignments will be made only to certified members of those officials' associations who are approved officials for the particular sport and who are members of the O.C.C. The Section reserves the right to remove assignment(s) at any time for just cause.

2.  Officials' associations shall supply a current officials' list no later than May 1st of each year. The list will include the following: Officers and all officials' addresses, home and business phone numbers.   The associations must provide the Section with known active/inactive status of members of the association by July 1st. Officers' names and meeting dates and all spring sports information will be supplied by July 1st.

3.  Upon request of either party, a conference shall be held prior to and after each sport season to review any concerns relating to that sport. Included in this conference shall be:

a.   A representative of the Office of the E.D. may elect to attend only the pre-season meeting.

b.   The Section VIII coordinator of that sport.

c.   Two representatives from the officials' associations including one rep from the O.C.C. if requested by the officials' association.

Items for discussion and resolution shall include but not be limited to assignment procedures; application of rating results to assignments; post schedule assignments and fees recommendations; however, any recommendations regarding fees must be submitted as stated on preamble item 3.b.l

4.   Availability sheets shall*be submitted to the E.D. no later than eight (8) weeks prior to the first scheduled contest for that sport. These exact dates are to be specified by the E.D. when the availability sheets are distributed to the officials. Within five weeks of the first contest for that sport no additional dates may be closed by an official without just cause. If an official wishes to close any additional dates during this period he/she will notify the E.D.

5.   Original assignments shall be received by the officials no later than three weeks prior to the first scheduled league contest for that sport. Officials shall confirm the acceptance of their assignments within ten days of receipt, or be subject to a non-monetary penalty.

6.  Additional or subsequent assignments may be made by E.D.'s Office via mail or telephone.

7.   Officials shall confirm their original assignments by mail, fax or e-mail to the home school athletic director. In the case of subsequent assignments, the official must phone to confirm the assignments with the Office of the E.D. and home school athletic director unless there is sufficient time to respond by mail or fax.

8.   Officials are to be on the field/court ready to officiate 15 minutes prior to the scheduled starting time.

9.   Any official who fails to fulfill an assignment shall report the facts in writing, within five

(5) working days, to the E.D. and the involved schools. 10. Officials who leave a contest before its completion will not be compensated.

11. Athletic directors shall notify the officials of any change in information about assignments as soon as they become known. The competing school(s) that cause(s) postponement or cancellation of a previously assigned contest shall notify opponents, the E.D. and the assigned official(s) regarding the reason(s) for said change. The E.D. will render a decision as to the acceptability and the resultant payment or non-payment of the applicable fees. This decision shall be final, subject to the grievance and appeals procedures (Article I, Section G and D2).

12. The home school administration shall provide for the physical safety of officials with emphasis on the following:

a.   Adequate and secure parking facilities.

b.   Private dressing and shower facilities, where possible, separate from the coaches, supervisory personnel and students with provision for a secure place for clothing and valuables. Upon request of the official these facilities shall be opened at halftime and immediately following the contest.

c.   Reasonable and proper crowd control with provisions for carrying out home management's responsibilities as called for by contest rules. Also, to include an escort by supervisory personnel at halftime and at the conclusion of the contest to the locker room and off school grounds if necessary.

d.   Officials shall notify the E.D., in writing, of any school that does not comply with the above. The E.D. shall respond, in writing, to the reporting official(s) and/or President of the Officials' Association within two weeks of receipt.

13. No official will be assigned to a contest where a conflict of interest exists. This must be indicated on the official availability sheet.

14. Officials must read the State Sportsmanship pledge to captains and/or participants prior to the start of all contests. .

15. Officials must report to the athletic director or the coach upon arrival to any contest.

16. Officials' associations should aggressively recruit new officials in those sports that cannot supply adequate coverage.

Section B - Rating Procedures

The Section VIII A.C. shall establish and maintain a joint committee to study the current system used for rating officials. This committee shall be made up of: one (1) representative of the E.D. and an equal number of members appointed from the A.C. and the O.C.C. (no fewer than three (3) from each). This Joint Committee shall meet within one month of the request of any of the parties or at least once per school year unless it is mutually agreed not to do so. The E.D. shall provide members of this committee with information describing all of the procedures used to generate ratings and rankings. Use of this information will enable the committee to properly identify existing and potential problems; make recommendations regarding viable and practical solutions; and most importantly, to provide any assistance which may become necessary for the implementation of newly agreed upon procedures.

1.   The minimum acceptable percentage of coaching rating responses will be as indicated below for all sports at all levels: 75% for the duration of this contract.

2.   The percentage of response of coaches' ratings form all member schools in each sport at each level will be made available to the joint rating committee.

At the completion of each season, a joint letter will be sent to the athletic directors from the Executive Director and the President of the O.C.C. notifying them of missing ratings. If a second notification is necessary, it will be sent to the principal of the school.

3.   A minimum number of contests to be worked by each official on all levels will be established on a sport by sport basis. Refer to conference^) in Article I, Section A, Item 3. These minimums shall also determine the required number of coaches' ratings on each level that will entitle an official to a rank among his/her peers. If after working the required minimum number of contests, an insufficient number of coaches' ratings are received, "automatic" ratings equal to the actual average of ratings received by that official on that level will be inserted to avoid the official from being penalized for a lack of ratings by the coaches.

4.   Any rating of four (4) or less (on the current scale) must be accompanied by an

explanation and constructive comments. In the absence of such comments, it will not be processed but will be returned to the A.D. for review and completion.

5.   A procedure to review, if necessary, any rating(s) involving coaches' ejections will be established. This procedure will not be initiated without an appeal by the involved official(s).

6.  It is agreed that all officials will be rated using the current rating system in place for the length of this contract. Individual ratings may be discussed between the president of each officials' association or his/her designee and the Executive Director or his designee.

7.   All officials must hand in a rating card at all contests, all levels.

8.   Tournaments that have the same format as regular contests will be rated (Section VIII member schools).

Section C - Grievance Procedure

A grievance may be initiated by the E.D., A.C. or O.C.C. based upon an alleged breach or misapplication of a specific term of this agreement.    Every attempt will be made by all parties to resolve the disagreement. If this proves not to be possible, the following procedures will be followed:

1.  Upon receipt of a written grievance from any party, the other party will respond in

writing within fifteen (15) business days after the receipt of the grievance. If the reply is not satisfactory to the grieving party, a written request for a hearing must be made within fifteen (15) business days from the receipt of the returned letter.

2.   A committee composed of representatives (at least 2) of the E.D. or designee and at least two representatives of the O.C.C. will meet within 15 business days to resolve the problem. The E.D. or representative will chair the meeting and vote only to break a tie.

3.   If the aggrieved party is not satisfied with the resolution, that party will notify the E.D. of Section VIII of the need for a full hearing. The E.D. will appoint a hearing officer mutually agreed upon by the A.C. and the O.C.C. (i.e. President of the AC or Chairman of the Superintendents' Board). There will be an equal number, at least two (2), of representatives from the A.C. and O.C.C. This hearing will be held within l 5 business days of receipts of the notification.

Section D

1.   Charges to be Assessed to Officials

a.   Late confirmation of acceptance of their original assignments (not within ten (10) days of receipt) - non-monetary charge.

b.  In the event that an official turns back any assignment, for an unacceptable reason, there will be a service charge of thirty dollars ($30.00) unless the turnback involves an original assignment which was received after the deadline established in Article I, Section A - #5; three weeks prior to the first scheduled league contest for that sport. Any official who turns back an entire schedule will be subject to a thirty dollar ($30.00) fee. Service fee will be adjusted accordingly on percentage of increase of fees.

c.   If an official is contacted, offered a contest within the framework of his/her availability and refuses to work the contest, he/she will be assessed a twenty dollar ($20.00) service charge,

d.   Late arrival to scheduled contest for an unacceptable reason - the charge is thirty dollars ($30.00).

e.   Failure to fulfill an assignment without just cause will be subject to a charge of one-half (1/2) fee (Article I, Section A9

 f.   Failure to submit a claim within three (3) weeks of the official's last contest for that sport will result in an administrative fee of thirty dollars ($30.00).

g.   The charges stipulated for the above six (6) situations shall be imposed unless the cause involves illness, injury, death or other reasons which are deemed acceptable by the Executive Director.

 2.  Notification and Appeals

When any monetary or non-monetary penalties involving, but not limited to, ratings or loss of assignments by an official are contemplated both the official and his or her organization will be notified five (5) working days prior to the implementation of such penalty. The official shall have the right to appeal any penalty to a three person Appeals Committee consisting of (1) O.C.C. Representative, (2) A.C. Representative, (3) E.D. or his designated representative. The official shall notify the E.D. in writing of the intent to appeal the penalty within five (5) working days after notification of the E.D.'s intention to impose a penalty. This does not include charges in Section Dl, A-G or Section A #1.

ARTICLE II. SECTION B - MISCELLANEOUS FEES & EXPENSES

1.   Cancellation/Postponement - full fee. In the event that a contest is postponed/cancelled, the assigned official(s) will receive a full fee unless:

a.   The cancellation is due to illness, injury, death, inclement weather or other acceptable reasons beyond the control of the school district as determined by the Office of the E.D.

b.   The officials receive an equal or higher level contest within the sport season as per their availability. All officials must keep their availability up-to-date.

c.   If a contest is cancelled, for an unacceptable reason, on the day it was scheduled and there is no replacement contest on that day the officials) will receive a full fee.

d.   When contests may be postponed because of obvious inclement weather conditions, the officials must contact the school within two (2) hours of the contest to ascertain whether the contest will be played. The official must note the name of the person (or voicemail) with whom he/she had contacted at the school. However, it will be the responsibility of the athletic director to contact the official(s) if the information is not available at the prescribed time. Officials who fail to contact the school may not receive a fee if upon arrival at the site the contest has been postponed or cancelled.

2.   Travel Fee - $33.00. Failure to notify official who appears for a contest that has been cancelled. 2006-07 - $34.00, 2007-08 - $35.00,2008-09 - $36.00.

3.  Forfeit Fee - Full fee. Contests postponed or called after 30 minutes delay without having been started.

4.  Delayed "late start" fees - Additional 1/4 fee. Any contest that is delayed 1/2 hour after scheduled starting time.

5.   Incomplete Contest - Full Fee. In the event of a suspension of play during a contest, the officials will wait a maximum of (90) minutes to resume play, if conditions warrant

6.   Less than full complement of officials - In a contest where more than two officials are scheduled to work and one or more fail to appear, the working officials shall share the fee(s) of the absent official(s). The fee shall not exceed a fee of one and one half.

7.   One official working a two official contest

The one and one-half (1 l/2) fee is applicable - In the event only one (1) official appears or is assigned to a two person contest, that official shall be required to work the contest. It is agreed that officials shall retain the right to indicate a preference not to work alone. This preference must be indicated on the availability sheet when it is returned..

8.   Official assigned as a timer/scorer or alternate during the regular season - regular junior high fee.

9.   In any modified junior high contest utilizing a 5th quarter of extended playing time officials will receive an additional 25% fee.

10.  During the period of the contract, a joint committee of the A.C., O.C.C. including the E.D. or his representative will evaluate problems such as realistic starting times, cancellations and single official contests. Also, to be discussed is the feasibility of the recruitment of a "cadet corps" of officials and master officials compensation. This committee will meet a minimum of two (2) times to specifically discuss single official contests.   If the O.C.C. side fails to meet this requirement, the one and one-half (1 Vi) fee clause (Article II, Section B7) will not apply on the non-varsity level effective June 30, 2009 unless a new contract has been agreed upon.

11. Every effort will be made by Section VIII to pay officials within thirty (30) days of the submission of their claim form.

Section C - Post-Schedule Contests

For those team sports in which post-season playoff contests are not separately addressed later in this contract and in which the contests are basically the same as the regular season (team sports); the fee shall be:

Regular Playoff: A 10% increase over the regular season fee.

County Semi-Finals/Championship: A 25% increase over the regular season fee.

Section Championship: A 40% increase over the regular season fee.

Alternate/Scorer/Timer: Shall receive JH fee plus applicable percentage.

Section D - Non-Standard Contest/Special fees

1.             Baseball - In semi-finals three (3) officials will be assigned. In finals four (4) officials will be assigned. The above items are to be implemented only if full availability is received by the top rated number of umpires required to cover these games.
